1. General Information
These Terms of Use govern access to and use of basicpatternblock.com and the purchase of products offered on it. The website is operated by ELENA SAMARA LTD, 2 Bulgaria Str., 2850 Petrich, Bulgaria (UIC:207557662 , VAT: BG207557662), referred to as “we”, “us” and “our”.
By using the website, you agree to comply with these Terms of Use. By placing an order and accepting these Terms at checkout, you confirm that you are at least 18 years of age and agree to be legally bound by the version of these Terms presented to you at the time of purchase. If you do not accept these Terms, you must not place an order or use the website.
We reserve the right to amend these Terms of Use at any time. The version published at the time an order is placed shall govern that order.
2. Products
We supply digital sewing patterns and associated digital files. All products are delivered electronically. No physical goods are sold or shipped.
Products are supplied as digital files intended for printing or on-screen use. Customers are responsible for ensuring they possess the software and equipment required to open, print and use the files. File formats and contents are stated on each product page.
Each product includes only the files, formats, sizes and materials expressly identified on its product page. Items not stated as included, such as sewing instructions, are not part of the purchase, and their absence does not make the product defective, incomplete or not as described. Customers are responsible for reviewing this information before placing an order.
Product images are illustrative. Finished garments will vary according to fabric, measurements and construction.
3. Orders
The submission of an order constitutes an offer to purchase. A contract is formed upon our issue of an order confirmation by email.
We reserve the right to decline or cancel an order where permitted by applicable law, including in the event of an obvious pricing error, suspected fraudulent or unauthorised payment, or breach of these Terms of Use. Where we cancel an order before the digital product has been supplied, any payment received will be refunded. Suspension or termination resulting from the customer’s breach after supply has begun does not entitle the customer to a refund, except where required by applicable law.
4. Prices and Payment
Prices are displayed in United States dollars (USD). Product-page prices exclude VAT. Where applicable, VAT is added at checkout and included in the final total shown before you place your order.
Applicable VAT is calculated at checkout using the customer’s billing country and, where relevant, verified business VAT details. Under our current below-threshold VAT arrangement, purchases by EU consumers and EU businesses without a verified VAT number are subject to Bulgarian VAT at 20%. Eligible business purchases from another EU member state are subject to reverse charge after successful VIES verification; a valid Bulgarian VAT number does not qualify for this cross-border treatment. Purchases by customers located outside the EU are not subject to EU VAT. Any other taxes we are required to collect will be shown before payment. VAT treatment and rates may change where required by applicable law.
Payment is due in full at the time of purchase. Payment is processed by Stripe and PayPal. We do not receive or retain full payment card details.
Prices are subject to change without notice. A change in price shall not affect an order already confirmed. Promotional codes are subject to the conditions stated with the offer and may be withdrawn for future purchases; withdrawal does not affect a discount already applied to a confirmed order.

5. Delivery
Delivery is electronic. Upon completion of payment, a download link is displayed on screen and is also transmitted by email, together with the receipt, to the address supplied at checkout. Where the customer holds an account, the files are additionally available in the account area.
Customers are responsible for supplying a valid email address. Where a confirmation email is not received, the customer should check spam and junk folders before contacting us. Download links shall be reissued on request.
Download links do not expire over time. Each purchased file may be downloaded up to 10 times; access to its download link ends once this limit is reached.
6. Licence to Use
Purchase of a pattern grants a limited, non-exclusive, non-transferable licence for single-user personal use. Ownership of the pattern and all intellectual property in it is retained by us.
Permitted
• Printing copies of the pattern for your own use.
• Sewing garments from the pattern for personal use or as gifts.
Not permitted
• Reproducing, sharing, distributing or transmitting the pattern files or printed copies, in whole or in part, in any format.
• Lending, selling, gifting or transferring the files or printed copies to any other person.
• Uploading the files to any file-sharing service, cloud folder, forum or other location accessible to third parties.
• Using the pattern for mass production, manufacturing or factory production.
• Using the pattern as teaching material in a class or workshop without our prior written permission.
• Removing or altering any copyright notice or identifying mark contained in the files.
Where a customer breaches this section, we may terminate the licence and suspend access to the affected files, to the extent permitted by applicable law. Such termination does not entitle the customer to a change-of-mind refund. We may pursue remedies for infringement of our intellectual property rights. Nothing in this section limits rights or refunds required by applicable law.
7. Intellectual Property
All patterns, instructions, illustrations, photographs and text published on the website are owned by or licensed to ELENA SAMARA LTD and are protected by copyright and other intellectual property rights. No right, title or interest in any such material is transferred by purchase or by use of the website.
8. Right of Withdrawal
Consumers in the European Union and the United Kingdom ordinarily have a fourteen-day right of withdrawal for distance purchases. For paid digital content not supplied on a tangible medium, this right is lost once supply begins, provided that the consumer has expressly consented to supply beginning during the withdrawal period, acknowledged the resulting loss of the right of withdrawal, and received the required confirmation.
We obtain express consent and acknowledgement at checkout before supply begins. Completing payment alone does not remove the right of withdrawal unless the applicable legal conditions have been met. This does not affect statutory remedies for digital content that is defective, incomplete or materially not as described.
9. Returns and Refunds
All sales are final for change-of-mind requests once digital supply has begun and the applicable conditions for loss of the right of withdrawal have been met. The circumstances in which a replacement file or refund is available are set out in our Refund Policy at https://basicpatternblock.com/privacy-policy/ . Nothing in these Terms limits refunds or other remedies required by applicable law.
10. User Accounts
Customers may register an account to manage orders and access downloads. Account holders are responsible for maintaining the confidentiality of their password, for the accuracy of the information supplied, and for all activity conducted under the account.
We reserve the right to suspend or terminate any account which we reasonably believe is being used in breach of these Terms of Use, including for the distribution of purchased files to third parties.
11. Prohibited Uses
The website may be used for lawful purposes only. The following are prohibited:
• Use for any unlawful, fraudulent or harmful purpose.
• Introduction of viruses, malware or other harmful code.
• Attempts to obtain unauthorised access to the website, its server or any connected system.
• Scraping, crawling or systematic extraction of content, other than ordinary search engine indexing.
• Interference with the operation of the website or with the access of other users.
12. User Submissions
When a customer submits a review, comment, photograph or other material, the customer warrants that the material is their own and does not infringe the rights of any third party. The customer retains ownership and grants us a non-exclusive, royalty-free licence to use, reproduce, display and adapt the material in connection with our business, including for marketing purposes. We are under no obligation to publish any submission and may remove content at our discretion.
13. Disclaimer
Our products contain the pattern files and any associated materials specified on the relevant product page. Sewing instructions, drafting instructions or construction guidance are included only where expressly stated. The outcome achieved is dependent upon the customer’s fabric, measurements, equipment and level of skill, none of which are within our control.
No warranty is given that a finished garment will fit or will correspond to the images displayed. Customers are advised to produce a test garment prior to cutting final fabric.
This section does not limit our responsibility in respect of a pattern which is defective, incomplete or materially not as described.
14. Limitation of Liability
To the fullest extent permitted by Bulgarian and EU law, our total liability in respect of any claim arising from a purchase shall not exceed the purchase price of the product concerned. We shall not be liable for indirect, consequential or incidental loss, including loss of profit or damage to fabric, materials or equipment.
Nothing in these Terms of Use excludes or limits liability which cannot lawfully be excluded or limited. The statutory rights of consumers are not affected.
15. Governing Law and Jurisdiction
These Terms of Use are governed by the law of the Republic of Bulgaria. Subject to mandatory consumer protection and jurisdiction rules, disputes shall be subject to the jurisdiction of the courts of Bulgaria.
Consumers retain any mandatory protections and rights to bring proceedings in the courts of their country of residence where provided by applicable law. Nothing in these Terms removes those rights.
